PrestaPoint general terms and conditions

Privacy

The Prestapoint.com operator collects the data which are essentially necessary for operating its activities  (for example, name, email). The data are not published further neither made available to other parties. On the basis of your request the data may be deleted from the database. 

Responsibility

The Author of the modules is not liable for any loss or damage of the user’s data. The user is obliged to consult the installation and espetially before the installation, the user is obliged to back up all it’s data.

The Modules with some exceptions are made so as not to interfere with the prestashop source code. The Modules only use the prestashop data and enlarge its functions. Therefore there is no risk of your data corruption and deletion. However despite all this, it is necessary to backup files and databases of your eshop!

The rights and obligations of the provider

• The provider is not liable for any misuse of the customer entry data, as long as the provider demonstrably did not cause the misuse.

• The provider is not liable for any defects or losses caused by software modifications made by the customer after the software sale.

• The provider is not liable for nonfunctional or limited functions of the supplied software after any modification made in the conditions or technical solutions in the supplied software by the customer or any other third party.

• The provider is not liable for trouble-free connection of the supplied software to third-party software.

• The provider has the right to cancel the order if the delivery of the ordered software is impossible. If the customer paid the ordered software in advance, then the provider will return to customer the full sum of money within 10 days from finding such fact.

•The provider is entitled to provide or sell given services, modifications and modules to third parties, unless this matter is in a specific form agreed individually or established in contract.

 •The provider reserves the copyright of implemented graphical and programming work, as well as individual designs, modules and modifications.

The rights and obligations of the customer

• The customer is obliged to provide only true and current personal information.

• The customer is obliged to secure the registration data, which were sent to him by the provider, and so prevent their misuse.

• The customer assumes full responsibility for all actions, changes and modifications that have been made by using registration data assigned by the provider.

License Agreement

• The licence is agreed on one web or one web project of the customer, unless the customer has purchased a multi-license.

• The licence is arranged as a non-exclusive license and for an indefinite period, unless stated otherwise.

• The copyrights and all other intellectual property rights, relating to the supplied software, remains a matter of the competent bodies as well as to their owners and are not affected by this agreement.

•In condition of the proper payment of the ageed price for granting the license, the provider grants to customer the license to execute the right to use the provided software only for its intended purpose.

• The customer is not authorized to grant sub-license. The customer is authorized to grant the rights to use the software only with the explicit consent of the provider.

• The customer is not entitled to lease, lend or sell the charged-software to third parties, unless the provider has expressed prior explicit consent to it.

• The customer is not entitled to exceed the quantitative scope of the license stipulated in the contract or determined by these terms and conditions.

• The customer is not entitled to remove, change, conceal, or otherwise interfere in any copyright or any other identifications of the respective bodies placed or stored anywhere in the supplied software or in the documentation distributed with it.

The copyrights of the supplied software, accessories or documentation belong to the provider. All logos, registered trademarks, trademarks, other brands and product names belong to their respective owners. When granting the license to operate the software, all the copyrights belong to the provider and to the author of the software. The customer doesn't gain by the granted license any provider's or third parties trademark rights.

• The copyrights are governed by the laws of the Slovak Republic.

• If the customer does not meet the above stated terms of license, the provider may require financial compensation in case of profit lost. 

• The provided  software as the author craft disposes in particular the protection of the Act. No. 121/2000 Coll. Copyright Act and the Act. No. 140/1961 Coll., of the Penal Code.
The customer is authorized to use the provided software only to the extent and in the form defined in these terms and conditions.

• In cases of the customer's interference to the providers copyright law, then the provider receives a claim for a penalty of up to 1000 EUR. The penalty is payable as per request for payment of the contractual penalty within 15 days from the request delivery. The provider's compensation rights for damages, caused by the customer's intervention to the copyrights of the provider, are not affected by the contractual penalty being paid by the customer.

• In case of the customer's intervention to the provider's copyrights, the provider has in additon to the claim for a penalty also claims arising from the copyright act, in particular claim of refraining from further encroachment on copyright, claim on communicating the details of the nature and extent of unauthorized use of the software and the right to remove the results of the intervention to the copyright, including the provision of adequate compensation and returning any unjust enrichment.
